These Terms & Conditions govern your use of Heron Sauna's website and your purchase and use of our sauna sessions, gift vouchers, memberships and other services.
By making a booking or purchasing a service from Heron Sauna, you agree to these Terms & Conditions.
Please read them carefully before making a booking.
Nothing in these Terms & Conditions affects your statutory rights as a consumer under Irish or EU law.
1. About Heron Sauna

Heron Sauna provides sauna, cold-water and associated wellness experiences at our premises in St Mullins, Co. Carlow, Ireland.
2. Bookings
Bookings can be made through our online booking system or through other booking channels made available by Heron Sauna.
When making a booking, you must provide accurate and complete information.
You are responsible for checking your booking confirmation and ensuring that the date, time and number of guests are correct.
A booking is confirmed once payment has been successfully processed and you have received a booking confirmation from us.
If you do not receive a confirmation, please contact us before attending.
Your booking is for the number of people stated on the booking confirmation. Additional guests may only attend where the capacity of the session permits and Heron Sauna has authorised the change.
3. Sauna sessions
Unless otherwise stated at the time of booking, sauna sessions are shared experiences and other customers may be present.
Each booking is for the duration stated at the time of purchase.
Customers must arrive in sufficient time to check in, change and prepare for their session.
Your session will finish at the scheduled time even if you arrive late.
Late arrival does not normally entitle you to an extension, refund or reduction in price.
Heron Sauna may need to alter the exact running arrangements of a session where reasonably necessary for safety, operational or maintenance reasons.
4. Prices and payment
All prices displayed by Heron Sauna are in euro (€) and include VAT where applicable.
The total price payable will be clearly displayed before you complete your booking.
Payment must be made using the payment methods made available by Heron Sauna.
We may use third-party payment providers to process payments.
Heron Sauna does not generally receive or store your full payment-card details.
A booking is not confirmed until the required payment has been successfully received.
We reserve the right to correct genuine pricing or display errors. If an error results in a materially incorrect price being displayed, we will contact you before processing the booking where reasonably possible.
5. Cancellation and changes to bookings
Because sauna sessions are leisure activities provided at a specific date and time, the statutory 14-day cancellation period that normally applies to many online service contracts does not generally apply to a booking for a specific sauna session.
This does not affect any other statutory consumer rights you may have.
Cancelling a booking
You may cancel a booking in accordance with the cancellation terms displayed during the booking process.
Unless a different cancellation policy is clearly stated when you make your booking:
-
cancellations made more than 24 hours before the scheduled session may be transferred to another available session or refunded at Heron Sauna's discretion;
-
cancellations made within 24 hours of the scheduled session are normally non-refundable;
-
failure to attend without prior notice will normally be treated as a late cancellation; and
-
where a refund is available, it will normally be made using the original payment method.
Where we offer a booking transfer instead of a refund, the replacement session must normally be taken within a reasonable period and is subject to availability.
Any cancellation fee will be limited to a reasonable amount reflecting the circumstances and the loss or costs reasonably incurred by Heron Sauna.
We will not seek to exclude or restrict any cancellation, refund or other remedy that you have under applicable consumer law.
6. Changing a booking
Subject to availability, we may allow you to change:
-
the date of your booking;
-
the session time; or
-
the number of people attending.
Requests to change a booking should be made as early as possible.
Changes requested within 24 hours of the session may not be possible.
If a booking is reduced in size, any refund will be subject to the applicable cancellation terms.
We will make reasonable efforts to accommodate booking changes but cannot guarantee that an alternative session will be available.
7. If Heron Sauna cancels your booking
We may occasionally need to cancel or reschedule a session because of:
-
equipment failure;
-
maintenance;
-
adverse weather;
-
health and safety concerns;
-
water-quality concerns;
-
power or utility failure;
-
staffing or operational problems;
-
circumstances outside our reasonable control; or
-
another circumstance where it is not reasonably safe or practicable to provide the service.
If we cancel a session before it begins, we will, where appropriate, offer you:
-
a transfer to another available session; or
-
a refund of the amount paid for the cancelled service.
If we cannot provide the service you booked, we will not require you to pay for a service that we have not supplied.
Nothing in these Terms & Conditions limits any statutory rights you may have where Heron Sauna fails to provide a service in accordance with applicable law.
8. Health and suitability
Sauna and cold-water activities can involve significant changes in body temperature and cardiovascular stress.
You are responsible for deciding whether participation is appropriate for you.
If you have a medical condition, are taking medication, are pregnant, have concerns about your health, or are otherwise unsure whether sauna or cold-water exposure is suitable for you, you should obtain appropriate medical advice before participating.
You must tell a member of Heron Sauna staff if you feel unwell or unsafe at any time.
You must not participate if you are feeling unwell, significantly impaired, intoxicated or otherwise unable to participate safely.
Heron Sauna may refuse or stop participation where we reasonably believe that continuing would create a health or safety risk.
This does not affect any liability that Heron Sauna cannot lawfully exclude or limit.
9. Alcohol and drugs
You must not attend or participate in a sauna or cold-water session while significantly impaired by alcohol or drugs.
For safety reasons, Heron Sauna may refuse admission or stop your participation if staff reasonably believe that you are intoxicated or impaired.
Where admission or participation is refused because of intoxication or impairment, this will normally be treated as a customer cancellation and no refund will be due, subject always to your statutory rights.
You must not bring or consume illegal drugs on the premises.
Alcohol may only be consumed where expressly permitted by Heron Sauna.
10. Cold-water facilities
Cold-water immersion is optional.
You should only use the cold-water facilities in a manner appropriate to your own ability and comfort.
Do not enter the cold-water facilities if you feel unwell, dizzy, excessively cold or otherwise unsafe.
You must follow all instructions provided by Heron Sauna staff and all safety information displayed at the premises.
Do not remain in cold water for an excessive period.
If you are unsure how to use a cold-water facility safely, ask a member of staff before entering.
11. Sauna rules
For the safety and comfort of all customers, you must:
-
follow staff instructions;
-
follow all signs and safety instructions;
-
use the sauna and facilities only for their intended purposes;
-
behave respectfully towards other customers and staff;
-
keep noise at a reasonable level;
-
maintain appropriate hygiene;
-
use towels or other protective materials as instructed;
-
report damage, accidents or safety concerns immediately; and
-
leave the premises when your booked session ends.
You must not:
-
intentionally damage or misuse equipment;
-
interfere with sauna heating equipment or controls;
-
pour liquids onto sauna equipment except where expressly permitted;
-
bring prohibited substances onto the premises;
-
behave aggressively, threateningly or abusively;
-
engage in conduct that creates a safety risk;
-
harass or intimidate other customers or staff; or
-
engage in sexual activity on the premises.
12. Children and young people
Children and young people are not permitted to use the facility at the Heron Sauna. All users must be a minimum of 18 years old.
13. Personal belongings
Customers are responsible for their own personal belongings.
Where lockers, changing areas or storage facilities are provided, you should use them appropriately.
Heron Sauna is not responsible for loss or damage to personal belongings except where such liability cannot lawfully be excluded or where the loss or damage results from our failure to exercise reasonable care.
Do not bring valuables onto the premises unless necessary.
14. Damage to property
You must take reasonable care of Heron Sauna's property and facilities.
If you deliberately or negligently damage property belonging to Heron Sauna, you may be responsible for the reasonable cost of repairing or replacing that property, subject to applicable consumer law.
We will not impose disproportionate or unreasonable charges.
15. Behaviour and refusal of entry
We want Heron Sauna to be a safe and welcoming environment for everyone.
We may refuse entry to, or ask a customer to leave, where reasonably necessary because of:

threatening or abusive behaviour;
-
harassment;
-
intoxication or impairment;
-
unsafe behaviour;
-
deliberate damage or misuse of facilities;
-
failure to follow reasonable safety instructions; or
-
conduct that materially interferes with other customers' enjoyment or safety.
Where reasonably possible, we will explain the reason for the decision.
Nothing in this section gives Heron Sauna an unrestricted right to refuse service on discriminatory or otherwise unlawful grounds.
16. Photography and recording
Customers must respect the privacy of other customers.
You must not photograph, film or record another customer without their permission.
Particular care must be taken in changing areas, toilets and other private areas. Photography or recording is prohibited in these areas.
Heron Sauna may occasionally take photographs or video for marketing or promotional purposes.
Where identifiable customers are included in promotional material, we will obtain any consent required by applicable law.
17. Gift vouchers
Gift vouchers are subject to the terms displayed when purchased and any applicable Irish consumer protection legislation.
Gift vouchers may be used towards eligible Heron Sauna services, subject to availability and any restrictions communicated at the time of purchase.
Unless otherwise stated, vouchers cannot be exchanged for cash.
Lost or stolen vouchers should be reported to us as soon as possible.
We will comply with the statutory rights that apply to gift vouchers under Irish law.
18. Memberships and recurring services
Where Heron Sauna offers memberships or recurring payment services, the specific price, benefits, duration, payment frequency, renewal arrangements and cancellation terms will be clearly displayed before purchase.
We will not automatically renew a membership on terms that are inconsistent with the information provided when you purchased it.
Where a membership can be cancelled, the cancellation procedure will be communicated clearly to you.
19. Customer consumer rights
Heron Sauna provides services in accordance with applicable Irish consumer protection law, including the Consumer Rights Act 2022.
Where a service does not conform to the contract, you may have statutory remedies depending on the circumstances.
Nothing in these Terms & Conditions is intended to remove or reduce those rights.
The Consumer Rights Act 2022 requires consumer contract terms to be transparent and prohibits unfair terms.
If there is a conflict between these Terms & Conditions and a mandatory statutory consumer right, the statutory right will prevail.
20. Liability
Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms & Conditions excludes or limits Heron Sauna's liability for death or personal injury caused by our negligence, or any other liability that cannot lawfully be excluded or limited.
Subject to the above, we are responsible for losses that are reasonably foreseeable and directly caused by our breach of the contract or failure to exercise reasonable care and skill, subject to applicable law.
We are not responsible for losses that are not reasonably foreseeable or that arise from circumstances outside our reasonable control, subject to your statutory rights.
You remain responsible for following safety instructions and taking reasonable care of your own health and belongings.
21. Events outside our control
We will not be responsible for a failure or delay in providing services where this is caused by circumstances beyond our reasonable control.
Examples may include:

severe weather;
-
natural events;
-
fire;
-
flooding;
-
utility failures;
-
serious equipment failure;
-
government restrictions;
-
public-health emergencies;
-
industrial disputes;
-
infrastructure failures; or
-
other circumstances that could not reasonably have been prevented or avoided.
Where such circumstances affect a booking, we will make reasonable efforts to notify affected customers and, where appropriate, offer a transfer or refund.
This section does not remove any statutory consumer rights that apply.
22. Complaints
If you are unhappy with your experience, please contact us as soon as reasonably possible.

We will investigate the complaint and attempt to resolve it fairly.
Nothing in this complaints procedure prevents you from exercising any statutory rights or legal remedies.
23. Privacy and personal data
Our collection and use of personal data is governed by our Privacy Policy.
Our Privacy Policy explains:

what personal data we collect;

why we collect it;
-
our lawful bases for processing;
-
who we share information with;
-
how long we retain it; and
-
your data protection rights.
24. Website use
You must not use our website:
-
for any unlawful purpose;
-
to interfere with the operation or security of the website;
-
to introduce malicious software;
-
to attempt unauthorised access to our systems;
-
to copy or reproduce website content without permission; or
-
in a manner that could damage or disrupt the website or our services.
We may temporarily suspend access to the website for maintenance, security or other operational reasons.
25. Intellectual property
Unless otherwise stated, the content of the Heron Sauna website, including text, logos, photographs, graphics, branding and other materials, belongs to Heron Sauna or is used with permission.
You may view and use the website for your personal, non-commercial purposes.
You must not reproduce, distribute, modify or commercially exploit our content without our prior written permission, except where permitted by law.
26. Changes to these Terms & Conditions
We may update these Terms & Conditions from time to time.
Changes may be made where necessary to reflect:
-
changes to our services;
-
changes to booking procedures;
-
changes to pricing or membership structures;
-
changes in law or regulatory requirements; or
-
changes to our business operations.
The latest version will be published on our website.
Changes will not retrospectively alter the terms of a booking that you have already made where doing so would adversely affect your statutory or contractual rights.
Where a material change affects an existing ongoing contract, we will provide any notice required by law.
27. Governing law and jurisdiction
These Terms & Conditions are governed by Irish law.
If you are a consumer living in another EU Member State, you retain any mandatory rights and protections provided to you by the law that applies to you.
Nothing in these Terms & Conditions prevents you from bringing proceedings in a court that has jurisdiction under applicable consumer protection law.
28. Severability
If any provision of these Terms & Conditions is found to be unlawful, invalid or unenforceable, that provision will be interpreted or amended to the minimum extent necessary to make it lawful and enforceable where possible.
The remaining provisions will continue to apply.
